Shiva.vu is an independent website that provides virtual goods, services, articles and documentation on IMVU and IMVU-related subjects. Shiva.vu is not part of, or related in any way with IMVU.com and/or its subdomains.

Shiva.vu provides access to a variety of services, including but not limited to, selling digital art, original articles and tutorials about IMVU, tips and tricks, business ideas and suggestions.

You are not allowed to use the services for any illegal or unauthorized purpose. You must not violate any applicable laws, rules, or regulations when using the services.

Articles and documentation on Shiva.vu

Information posted on Shiva.vu is completely original* and meant to be consumed on Shiva.vu.

*Information snippets might be included and referenced in articles from other websites such as IMVU Terms of Service, IMVU Creator Agreement etc. Every article documentation that is taken from a different source will be noted as such and it will have its source shared in the article.

Copying, re-distributing, and/or partly altering the content on other websites is strictly forbidden.

Referencing articles, tutorials, or parts of the articles (snippets) is allowed as long as the source/original Shiva.vu article is referenced.

Purchased goods and services

By visiting Shiva.vu and/or signing up for Shiva.vu and/or purchasing any goods/services on Shiva.vu, you agree to the Terms of Service presented in this document, as well as any other information available individually on each page of the product/service/article.

The products are sold "as is" without any warranties, express or implied. Shiva.vu does not guarantee that the products will meet your specific requirements. Shiva.vu is not responsible for any damages resulting from the use or inability to use the products.

1. License for virtual goods

Shiva.vu textures, meshes, skins, mesh heads, icons, opacity maps, freebies are granted as a standalone license per IMVU Customer ID / Member Number.

Brushes, patterns, artwork, backgrounds are granted as a standalone license per person.

You may use as whole or in part, modify the texture resources purchased for the account on which you purchased the files. You have commercial rights for all files purchased on Shiva.vu (post on social media, include in commercial/derivative projects, use in banners, showcases etc., use for an unlimited number of sales in the IMVU shop). You are strictly forbidden to share or distribute as whole or in part, unaltered or modified version of the virtual goods purchased. You may not share/distribute any of the virtual goods purchased, or include them in online/offline archives or resource websites. 

a) Baby hair meshes

You are strictly forbidden to hide the 3D watermark embedded in the mesh. You may set hairs as derivable, as long as you  do not offer sample baby hair opacity maps. You may not fill in DMCA claims for the baby hair mesh file. By purchasing a custom watermark for the baby hair mesh, Shiva.vu grants you the right to fill in DMCA takedown notices solely against products that have the Shiva Baby Hair mesh with your exact name inside of the mesh as provided by Shiva.vu and only after Shiva.vu has been contacted of such actions taking place (inform Shiva.vu by sending an e-mail of the content theft and that you will be filling a DMCA takedown notice). Shiva.vu is not responsible for any clipping issues that might occur between baby hair meshes and other IMVU products.

b) Baby hair textures/opacity maps

Opacity maps which result from parts of the bundle cannot be resold or distributed in any way. You can make unlimited baby hair opacity maps with the bundle provided, as long as every texture resulted from using the bundle in whole or part will be used on the account the files were purchased without redistributing, reselling, giving away the resulted opacity maps. You may not share or distribute the UV maps provided for the Baby hair meshes.

You may not file DMCA against another creator that has created a similar opacity map using Shiva.vu baby hair stamps/DIY textures. You can only file DMCAs against someone else if you are absolutely sure that the resulting baby hair opacity map/texture is 100% identical to yours. Only in the case of identical textures, pixel by pixel (or slightly positioned in a different direction), where there is 100% similarity or very high similarity beyond a reasonable doubt, only then may you file a DMCA.

Clarification with an example:

If you are creating a baby hair opacity map with a curly hair strand that you place in 5 places on the texture, any other customer/person who has access to the same license purchased that contains the curly hair strand you used MAY create the exact same style like you did. In this case, you are not allowed to file a DMCA, as the idea of babyhair is not copyrighted, only the work you create. However, for the second person creating the same style of baby hair texture like you (e.g. doing the exact same drag and drops and rotations and placing the hair strand similarly to your original creation), it is impossible to make a pixel-by-pixel inspired opacity map. In case of identical textures or very similar (your exact texture slightly blurred or moved slightly up/down/left/right or used as a base for adding some other hair – which can be original or not) it must be proven beyond a reasonable doubt that the person used the EXACT texture you made without your consent – in such cases, you can file a DMCA (remember, the DMCA you are filing is for the full generated baby hair opacity map after using your valid license from www.shiva.vu).

If the person has your consent to use the baby hair texture, but does not have a valid www.shiva.vu license to use the baby hair stamps/texture, regardless how these are arranged, positioned, edited, etc., – as long as it is proven/determined beyond a reasonable doubt that the files are from Shiva.vu – Shiva.vu has the right to file a DMCA takedown against the targeted product/shop/website that is not complying with Shiva.vu’s terms for Purchased Goods & Services (remember, the DMCA Shiva.vu would be filing in this case would be for the misuse of the individual baby hair stamps/textures for which the person using them does not have a license).

c) Meshes

Mesh products may only be used on one IMVU account (final availability).

Meshes purchased from www.shiva.vu may be set as derivable.

UV maps, textures, shaders included in the bundle of the purchased mesh may be shared for derivation (e.g. post the images in the product description).

You are allowed to make unlimited hidden derivation chains, as long as the final, derivable, visible product is connected to the account for which the file/s were purchased.

Meshes may not be redistributed, sold, shared as whole or part in any way.

Crediting is not required.

Meshes may be bundled together with other meshes (e.g. adding a skirt to a top mesh purchased from Shiva.vu) and added to the catalog and may be set as derivable.

Shiva.vu cannot impose terms on the final price in the catalog. However, for fair market competition, Shiva.vu recommends to set a profit of at least 50 IMVU credits.

d) Brushes

Brushes are made and tested in Adobe Photoshop CC 2019, Adobe Photoshop CC 2020, Adobe Photoshop CC 2021, Adobe Photoshop CC 2022, Adobe Photoshop CC 2023, Adobe Photoshop CC 2024, Adobe Photoshop CC 2025. Shiva.vu does not guarantee that Shiva.vu brushes work with any other Software, or Adobe Photoshop version, other than the versions mentioned above.

Shiva.vu will not issue refunds to customers who purchase any Shiva.vu brushes with the intent of using them with any other version, or software, other than the versions mentioned above.

Brush licenses are per person, not per account, or platform.

2. Custom Product Orders

2.1 Ownership and Intellectual Property Rights

• • All custom products created by Shiva.vu (including but not limited to mesh heads, skins, lips, hair textures, and other digital items) are the exclusive intellectual property of Shiva.vu and remain the sole property of the creator.
  • By purchasing custom products, you acknowledge that you are granted a limited, non-transferable license to use the products only on the IMVU platform (www.imvu.com). These products are not intended for use in any other virtual worlds, games, or platforms.
  • No Ownership Rights: You understand and agree that by purchasing custom products, you are not acquiring ownership or rights to the underlying meshes, textures, or files used to create the product. All intellectual property rights, including copyright, trademark, and design rights, remain the sole property of [Your Website Name].
  • You are prohibited from redistributing, reselling, or sharing the files, meshes, textures, or any part of the custom products in any form. The digital files provided to you are strictly for your personal use on IMVU and are not to be shared, modified, or used outside of that platform.

2.2 Use of Custom Products

• The custom products you receive from purchasing the custom service through Shiva.vu are for personal use on IMVU only. You may not use these products in any other virtual world, platform, or game.
• The products are to be used solely in accordance with the rules and guidelines set by IMVU. Any use of the product outside of IMVU or in violation of IMVU’s terms of service is strictly prohibited and may result in the suspension of your IMVU account or legal action.
• You may not alter, modify, or create derivative works based on the custom products for redistribution or commercial use.
• Shiva.vu, or Shiva@IMVU will not be held responsible for any misuse of custom products or services that might suspend a user's activity on IMVU temporarily or permanently.

2.3 Delivery and Files

• • After completing your purchase, you will receive the custom product (e.g., mesh head, skin, lips) as a gift from Shiva or Shivare on www.imvu.com. However, you will not be provided with the original files, textures, meshes, or any proprietary assets used to create the product.
  • No source files, including editable textures or meshes, will be shared or made available to you. All such materials remain the property of Shiva.vu and are kept confidential.

2.4 Promotional Use and Replication

• By purchasing custom products from Shiva.vu, you agree that Shiva.vu retains the right to use the custom products in promotional materials, including but not limited to advertising, website content, social media posts, and portfolio showcases.
• Additionally, Shiva.vu reserves the right to create an unlimited number of derivative copies or similar products based on the custom product created for you. These derivative copies may be used for promotional purposes, other projects, or for sale, but the original custom product will not be resold or transferred to anyone other than the original purchaser (you). These derivative copies will not be the exact original product and will be distinct from the custom product created specifically for you.

2.5 No DMCA Takedowns

• You acknowledge that the custom products provided to you are protected by copyright laws and that Shiva.vu holds all intellectual property rights associated with these products. By purchasing these products, you agree that you will not initiate or participate in any DMCA takedown requests or claims regarding the products.
• If a third party attempts to file a DMCA takedown or any other intellectual property-related claim against your use of the products on IMVU, you agree to support Shiva.vu in defending against such claims, including providing necessary documentation or proof of purchase.

2.6 Customization and Requests

• Custom products are made to order based on your specific requests. You are responsible for providing clear, accurate instructions for any customization you wish to be made. Shiva.vu  is not liable for dissatisfaction if instructions are unclear or incomplete.
• Once an order for a custom product has been processed and delivered, no refunds will be issued.

2.7 Prohibited Uses

• • You may not use the custom products for the following purposes:
  • Commercial resale or distribution (either directly or indirectly).
  • Modifying, copying, or redistributing the product files (including textures, meshes, or other components).
  • Incorporating the products into other digital assets (e.g., creating resellable virtual goods) without Shiva.vu's written permission.
  • Using the product for fraudulent or malicious activity on IMVU.

2.8 Account Suspension and Violations

• Any violation of these terms, including but not limited to the unauthorized use, modification, or redistribution of custom products, may result in the suspension or termination of your account with Shiva.vu, as well as legal action, if applicable.
• You agree to indemnify Shiva.vu from any claims, damages, or expenses arising from your misuse of the custom products, including violations of intellectual property rights.

2.9 Indemnification

• You agree to indemnify, defend, and hold harmless Shiva.vu, its officers, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from your use or misuse of the custom products, your violation of these terms, or your violation of the rights of any third party.

2.10 Changes to Terms

• Shiva.vu reserves the right to modify or update these terms at any time. Any changes will be reflected on this page, and your continued use of the custom products will constitute your acceptance of the revised terms.

As the services provided on www.shiva.vu result in the creation of a virtual product (e.g. Custom Mesh Head), in case of a dispute, there will be no refunds issued, instead, the buyer has revisions available (2 for Limited Mesh Heads, 3 for Exclusive Mesh Heads) that must be communicated to Shiva.vu in maximum 72 hours after the service delivery (delivery means the original creation of the custom product and then every single edit which will be announced by Shiva in writing on the platform the customer and Shiva are exchanging information for the service – custom product – desired, which can include, but are not limited to: www.imvu.com, email, Instagram, Discord, etc.)

Shiva.vu WILL always have to announce the implementation of the revision in writing and only after the written notification will the 72h countdown start.

Delivery time for custom products

For custom mesh heads and custom lips, the delivery time is 20 working days. Shiva.vu's working days are Monday, Tuesday, Wednesday, Thursday, Friday.

Shiva.vu does not take into account Peer Review time.

Delivery time for revisions is 7 working days per revision.

Multiple revisions available

Shiva.vu offers revisions for custom products such as mesh heads and lips. However, this process is subject to a 72-hour rule in which after being notified in written (the customer) by Shiva that the product has been revisioned, the customer has 72 hours to request additional changes.

To limit potential abuse, Shiva will change the head base only once (e.g. if you initially want the mesh head to have the Zell base, but then decide to switch to Diane, Shiva.vu will create a new head using the new head base with your requirements and gift you the new head that goes through the same feedback loop process, but without the possibility of switching the head base any longer, with the exception of rolling back to the initial head base chosen).

3. Artwork

Shiva.vu may offer AI-generated artwork or digital content (the "AI Artwork"), created with artificial intelligence tools or technologies. By purchasing, downloading, or using AI-generated artwork from Shiva.vu, you agree to the following terms:

3.1 License and Usage Rights

Upon purchasing AI-generated artwork from Shiva.vu, you are granted a non-exclusive, transferable, sublicensable, royalty-free, and commercial license to use the AI Artwork. This commercial license includes the right to:

• Use the AI Artwork for any commercial purpose, including but not limited to reselling, distributing, marketing, or incorporating the AI Artwork into products, services, or advertising.
• Modify, adapt, or create derivative works of the AI Artwork as part of your business activities, without any additional fees or royalties owed to Shiva.vu.
• Use the AI Artwork in any format, including print, digital, and online platforms, for personal or commercial applications.

You may use the AI Artwork across any medium, including but not limited to websites, social media, merchandise, and marketing campaigns, without any time or geographic restrictions.

3.2 Prohibited Uses

While the AI Artwork is granted a commercial license, the following uses are strictly prohibited:

• Infringement of Third-Party Rights: You may not use the AI Artwork in a way that violates any copyright, trademark, or other intellectual property rights of others. You are responsible for ensuring that the AI Artwork does not infringe upon third-party rights.
• AI Training or Model Use: You may not upload, share, or use the AI Artwork for training AI or machine learning models or use it as input for any generative AI systems, unless authorized by Shiva.vu.
• Defamation or Offensive Content: You may not use the AI Artwork in a manner that is defamatory, offensive, or promotes harmful or illegal activity, including but not limited to hate speech, violence, or discrimination.

3.3 Attribution

Attribution is not required for commercial use of the AI Artwork. However, if you choose to credit Shiva.vu or the AI technology provider, it is appreciated but not mandatory.

3.4 Ownership and Copyright

The AI-generated artwork remains the intellectual property of Shiva.vu. By purchasing the AI Artwork, you receive a commercial license to use it for your business purposes as outlined above, but you do not obtain exclusive ownership of the artwork. All rights not expressly granted to you are reserved by Shiva.vu.

You may sell or license the AI Artwork as part of your own products or services.

3.5 Modifications and Derivative Works

You are permitted to create derivative works of the AI Artwork and use those modifications commercially. This includes altering, adapting, or combining the AI Artwork with other elements to create new products for resale or distribution. The commercial use of these modified versions is fully permitted under this license.

3.6 No Warranty

AI-generated artwork is provided "as is," with no warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Shiva.vu does not guarantee that the AI Artwork will meet your requirements or be free of defects, errors, or issues.

3.7 Indemnification

You agree to indemnify and hold harmless Shiva.vu, its affiliates, and its licensors from any and all claims, damages, losses, liabilities, and expenses arising from your violation of these terms or misuse of AI-generated artwork. This includes any claims related to infringement of third-party rights or improper use of the artwork.

3.8 Changes to AI-Generated Artwork Policy

Shiva.vu reserves the right to update or modify the AI Artwork terms at any time. Any changes will be posted on the Site, and your continued use of the AI Artwork after such changes will constitute acceptance of the revised terms.

4. Face references

By purchasing and downloading any digital face reference from Shiva.vu, you agree to the following terms:

4.1. Permitted Uses

• You may modify, alter, extract, and customize any part of the reference.
• You may use it for creating makeup, 3D textures, digital art, illustrations, and other creative works.
• You may sell or distribute derivative works that incorporate or are based on this reference.

4.2. Prohibited Uses

• You may not sell, share, or redistribute the original file in its unmodified form.
• You may not claim authorship of the original reference image.
  
  

4.3. Support & Liability

• Shiva.vu does not offer customized support by default for fitting the reference head to any project.
• Shiva.vu does not provide training on how to use or modify the reference image.
• It is the customer’s responsibility to understand how to utilize the image for their desired projects.
• No refunds will be issued for lack of knowledge or improper use of the reference.

4.4. Custom fitting service for IMVU mesh heads

• Shiva.vu can offer a premium service to fit the face reference image to one single IMVU head base for a price.
• The resulted 2D texture will be delivered to the customer's email in .JPG, .JPEG, or .PNG format.
• The fitting will be done with no alterations available.
• The resulted texture will fit the head base desired and will be the ownership of the customer.
• Shiva.vu can fit the reference eyes for IMVU eyes as a premium service. The edit will be done once with no alterations available and the resulting file will be sent as a .JPG, .JPEG., or .PNG file to the customer's email address.

4.5. Intellectual Property

• This purchase grants you an exclusive license to use the digital reference within Shiva.vu's Terms of Service.
• You own the copyrights of any derivative works created using the head reference.
• You own the copyrights of the fitted service purchased (fitting the face reference to a 2D texture for an IMVU head base, fitting the face reference to a 2D texture for IMVU eyes).
• You may sell any derivative works created using head references.

Name changing on IMVU

As of 15 February 2025, licenses purchased on Shiva.vu require the customer ID / member number on IMVU, a unique number-identifier issued to every single IMVU user upon registration. For the limited user license products sold on Shiva.vu, you are issued a standalone, unique license to your customer ID and are gived permission to use the items purchased exclusively for the registered CID and subsequently shop associated with the CID.

The permission can be removed permanently if you breach the license of the item purchased and/or Shiva.vu terms, as well as any suspicious behavior or activity that is deemed fraudulent and in breach of Shiva.vu's Terms.

If you have purchased products and registered the license under an IMVU username, you have 90 days from the name change to notify in writing Shiva.vu of your IMVU Customer ID / Member Number to license purchased files to your unique IMVU CID.

If you hold a license for multi-usage prior to 15 February 2025 and have your name changed, you have 90 days from the name change to notify in writing Shiva.vu of your IMVU Customer ID / Member Number to attribute the second license to your alt account through its unique IMVU CID.

Failure to do so will result in copyright takedowns without warnings and/or terminating your Shiva.vu virtual goods license.

Miscellaneous

In the event of becoming permanently disabled, Shiva.vu will grant you a free license to reuse all goods purchased on a second account, which will become the primary account holder of the files. Shiva.vu will need proof of the type of ban sent to contact@shiva.vu, along with the request for a free license to reuse all the purchased virtual goods.

Re-licensing will only be done for one disabled account only.

This is available for custom products as well, such as custom mesh heads and custom lips.

Shiva.vu can deny re-licensing of the files if Shiva.vu believes the request is done in a malicious way to bypass purchasing multiple licenses, or doesn’t comply with the Terms of Service of www.shiva.vu. 

License removal

Failure to comply with Shiva.vu's Terms of Service will result in immediate termination of your digital goods licenses purchased on Shiva.vu.

Account Creation and Security

In order to purchase products from the Site or access certain features, you may be required to create an account. You agree to provide accurate and complete information when creating an account and to update such information if it changes.

You are responsible for maintaining the confidentiality of your account information and password and agree to notify Shiva.vu immediately of any unauthorized use of your account.

Order and Payment Information

Shiva.vu accepts payment through PayPal. All payments are processed through PayPal’s secure payment system. You are responsible for providing accurate billing and payment information. Shiva.vu reserves the right to cancel any order if it suspects fraud or if the payment is declined.

• Pricing: Prices for our products are listed in dollars. All prices are subject to change without notice. We reserve the right to modify or discontinue products at any time.
• Payment: We accept various payment methods including credit cards and PayPal. By submitting your payment information, you represent and warrant that you have the legal right to use the payment method you provide.
• Order Confirmation: After placing an order, you will receive an order confirmation email. Please review the order details carefully and contact us immediately if there are any discrepancies.

Prohibited Use for AI Learning

You agree not to use any products or content from Shiva.vu for the purpose of training AI, machine learning, or similar technologies. Any such use is strictly prohibited and may result in legal action.

Intellectual Property Rights

All content on the Site, including but not limited to, graphics, logos, articles, images, videos, and product designs, are the property of Shiva.vu and are protected by intellectual property laws. You may not reproduce, distribute, or use any content from Shiva.vu without our explicit permission.

Downloads of purchased files

You may download the purchased files an unlimited number of times, subject to the conditions outlined below:

• Unlimited Downloads is defined as being available for the lifetime of the domain www.shiva.vu, and may be subject to change or termination at any time. The lifetime of the domain is defined as the duration in which the domain www.shiva.vu remains active and accessible for downloading files.
• Shiva.vu reserves the right to modify or cancel this download policy at any time, at its sole discretion, without prior notice. However, we guarantee at least one successful download for each purchased file. After this download, availability may be affected by the domain's status or other factors, and no further notifications will be provided if the policy changes or if the download functionality becomes unavailable.
• By purchasing the files, you acknowledge and agree to these terms and accept that the availability of downloads may be impacted by the domain's status or other factors, and that no refunds or claims for inaccessible files will be accepted due to changes in this policy.

User Content

You may have the opportunity to upload or share content, such as designs, reference photos, reviews, or feedback, on the Site. By submitting content, you grant Shiva.vu a worldwide, non-exclusive, royalty-free license to use, modify, and display such content in connection with the operation of Shiva.vu and Shiva.vu services. You are solely responsible for the content you submit, and it must comply with our content guidelines.
